TERMS AND CONDITIONS OF USE (EULA)

1. Introduction and Acceptance

Welcome to SaidRight (hereinafter, the "App"). These Terms and Conditions govern the access and use of our mobile application and website.

The App is operated by Germán Asencio Antón (hereinafter, the "Developer"), based in Elche (Spain).

By downloading, installing, or using the App, you agree to be legally bound by these Terms. If you do not agree with any part, you must not use the App.

2. Service Description and AI Technology

The App is a writing assistance tool that uses Artificial Intelligence (AI) to rewrite, translate, or modify texts provided by the user.

2.1. Nature of AI (Disclaimer)

PLEASE READ CAREFULLY: The App uses advanced language models (currently OpenAI, but subject to change). AI is prone to "hallucinations" (factual errors) and may generate inaccurate, offensive, or incoherent information.

Not Professional Advice: The App DOES NOT replace professional advice. You agree that you will not use the generated texts for legal, medical, financial, or critical safety purposes without human expert supervision.

User Responsibility: You are solely responsible for reviewing and verifying the accuracy of texts before using, publishing, or sending them. The Developer is not liable for consequences resulting from the use of texts containing errors.

2.2. Change of Providers

The Developer reserves the absolute right to change, update, or replace the underlying Artificial Intelligence models (e.g., switching from GPT to Claude, Gemini, Llama, etc.) at any time and without prior notice, to improve the service or optimize costs, provided that the essential rewriting functionality is maintained.

3. Accounts and Acceptable Use

3.1. Registration

To use certain features, you must register via Google. You are responsible for maintaining the confidentiality of your account.

3.2. Prohibited Use (Zero Tolerance)

It is strictly prohibited to use the App to generate content that:

Is illegal, defamatory, harassing, or threatening.
Incites hate, violence, or discrimination.
Is sexually explicit (NSFW) or pornographic.
Violates third-party intellectual property rights.

Ban: We reserve the right to immediately suspend or delete, without refund, the account of any user violating these rules.

3.3. Rate Limiting

To ensure service stability, we establish a technical limit of 20 requests (rewrites) per minute per user. If this limit is exceeded, the service will be temporarily paused.

4. Credits, Payments, and Subscriptions

The App operates on a "Credits" system. There are three ways to obtain them, with different validity conditions:

4.1. Subscriptions (Recurring)

Plans: We offer Monthly and Annual subscriptions.
Subscription Credit Validity: Credits granted by the subscription are valid only during the billing cycle (the current month or year).
Expiration: If you cancel the subscription or the period ends, unused subscription credits are removed and do not accumulate. Upon payment renewal, the counter resets.

4.2. One-Time Purchases (Credit Packs)

We offer one-time payment credit packs (non-recurring).
Validity: These credits NEVER expire as long as your account is active. They will always be available, even if you do not have an active subscription.

4.3. Rewarded Ads

You can earn credits by watching advertisements.
Validity: These credits NEVER expire and are added to your permanent balance.

4.4. Consumption Order

The system will automatically consume credits with an expiration date (Subscription) before permanent credits (Purchases/Ads).

5. Payments, Refunds, and Right of Withdrawal

5.1. Payment Processing

All transactions are processed through official app stores (Apple App Store and Google Play Store). The Developer does not store your financial data.

5.2. Waiver of Right of Withdrawal

As this involves immediate delivery of digital content, and in accordance with European and Spanish consumer regulations, you acknowledge and accept that upon purchasing and receiving credits immediately, you waive your 14-day right of withdrawal.

5.3. Refund Policy

General Rule: Refunds are governed exclusively by the policies of the store where the purchase was made (Apple or Google). Generally, purchases are final.
Voluntary Exception: Notwithstanding the above, if you experience a serious technical failure and credits have not been consumed, you may contact us. The Developer reserves the discretionary right to evaluate the situation, although the final refund depends technically and legally on the platform (Store).

6. Intellectual Property

6.1. Your Texts (Inputs and Outputs)

You retain full ownership and intellectual property rights over the texts you input (Inputs) and the texts generated by the App (Outputs).

Commercial Use: You are free to use the generated texts for personal or commercial purposes.

6.2. App License

By using the service, you grant the Developer a worldwide, non-exclusive, royalty-free license to process, encrypt, and store your texts solely for the purpose of providing the service, displaying your history, and conducting anonymous internal quality analyses.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided "as-is", without warranties of any kind.
The Developer shall not be liable for indirect, incidental, or consequential damages, nor for loss of profits or data.
In no event shall the Developer's total liability exceed the amount you paid for the App in the last 12 months.

8. Modifications to Terms

We may update these Terms at any time. Modifications will take effect upon posting in the App. Continued use of the App implies acceptance of the new terms.

9. Governing Law and Jurisdiction

These Terms are governed by Spanish law.

For any dispute that cannot be resolved amicably, both parties submit to the exclusive jurisdiction of the Courts of the city of Elche (Alicante), Spain, waiving any other jurisdiction that might correspond to them, unless consumer law imperatively provides otherwise.
